Names Trainer Terms of Service

Effective: [EFFECTIVE DATE] Operator: [COMPANY/OPERATOR NAME], [POSTAL ADDRESS], [CONTACT EMAIL]

These terms apply when you use Names Trainer on the web or from the Apple App Store or Google Play. By using the app you agree to them. If you do not agree, please do not use it.

1. What the app is

Names Trainer is a flashcard app for learning people's names from their photos. It works on your device without an account. An optional account lets you back up and share decks. Our Privacy Policy explains how data is handled and is part of these terms.

2. Your account

You must be at least 13 years old (16 where local law sets a higher age) to create an account. You sign in with a link sent to your email address, so keep that mailbox secure. You are responsible for what happens under your account.

3. Your content

"Your content" means the photos, names, notes, memory hooks, and deck titles and descriptions you add to the app.

You own it. We claim no ownership of your content.

Licence to us. So the app can work, you give us a limited, non-exclusive, worldwide, royalty-free licence to store, resize, copy, and display your content, only as needed to provide the service to you and to the people you choose to share a deck with. If you publish a deck, that includes showing it to anyone who uses the app while it stays published. The licence ends when you delete the content or your account, except for copies in routine backups, which expire shortly afterwards, and copies other people already installed from a deck you published.

You are responsible for it. You confirm that you have the right to upload your content and share it with whoever you share it with, including any permission you need from the people pictured.

4. Acceptable use

Do not use Names Trainer to:

We may remove content, unpublish a deck, or suspend or close an account that breaks these rules. Serious or repeated breaches lead to permanent closure.

5. Sharing and publishing

Decks are private by default. Sharing by link lets anyone with the link study the deck after signing in; you can see who has joined, remove people, and stop the link. Publishing makes a deck public. Before publishing you must confirm that the people in it are public figures or have agreed. We may unpublish a deck at any time if we receive a valid complaint or believe it breaks these terms.

6. Starter packs and attribution

Starter decks contain photos of public figures from Wikimedia Commons under Creative Commons or public-domain licences. The photographer and licence are shown on each card and listed in the deck's credits. If you export or reuse those photos, follow their licence terms. If you believe a starter-pack photo is mislicensed, email [CONTACT EMAIL] and we will review and, if needed, replace it.

7. Reports and takedowns

Anyone can report a deck from within the app or by emailing [CONTACT EMAIL]. Our process, response targets, and handling of repeat problems are in report-and-takedown.md. If your photo appears in someone's deck and you want it removed, use the same route. We respond to copyright notices under the DMCA and equivalent laws at [CONTACT EMAIL].

8. Ending your account

You can delete your account at any time from Settings or by emailing [CONTACT EMAIL]. Deleting your account deletes your decks, photos, and progress from our servers. Decks you published that others already installed may remain in their libraries.

We may suspend or close your account if you break these terms, if the law requires it, or if we discontinue the service. If we discontinue the service, we will give at least [30] days' notice where we can, so you can export your data.

9. The app stores

If you installed Names Trainer from the Apple App Store or Google Play, the store's terms also apply. Apple and Google are not responsible for the app or for support, and Apple is a third-party beneficiary of these terms with the right to enforce them against you.

10. Disclaimers

The app is provided "as is" and "as available". We do not promise it will be error-free or uninterrupted, or that it will help you remember anyone's name. It is not a security, identification, or verification tool and must not be used as one. Keep your own backup; the app can export everything.

Nothing in these terms limits consumer rights that cannot be limited by law.

11. Limitation of liability

To the fullest extent the law allows, [COMPANY/OPERATOR NAME] is not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of data, profits, or goodwill, arising from your use of the app. Our total liability for any claim is limited to the greater of the amount you paid us in the 12 months before the claim and [US $50]. This does not limit liability for fraud, gross negligence, wilful misconduct, death, or personal injury, or any liability that cannot be limited by law.

12. Indemnity

If someone brings a claim against us because of content you uploaded or because you broke these terms, you agree to cover our reasonable costs and losses from that claim, to the extent the law allows.

13. Governing law and disputes

These terms are governed by the laws of [JURISDICTION]. Disputes will be heard in the courts of [JURISDICTION], unless you are a consumer in a country whose law lets you bring claims at home, in which case you keep that right. Before going to court, please email us; most problems can be sorted out quickly.

14. Changes to these terms

We will post any new version with a new effective date and, for material changes, notify signed-in users by email or in the app at least [14] days before they take effect. Continuing to use the app after that means you accept the new terms.
